2. Our products
2.1. The main characteristics of the products: Detailed information about our products is given in connection with the products as they are presented on the Website. Please note that images of products and packaging on the Website are for illustrative purposes only. Small variations may therefore occur between the delivered product and/or packaging, and the image of the product and/or packaging available on the Website.
2.2. We sell nicotine products: Our products and our product samples contain nicotine, which is a highly addictive substance.
3. Purchases and orders
3.1. Eligibility: We only accept purchases and orders from people who are 18 years of age or older. At the beginning of the purchase/order process, you will be asked to verify your age through an online service. Once this verification is complete, you will be able to complete the order form and/or complete your purchase.
3.2. Ordering process: You can complete a purchase of our products or an order for product samples online via our ordering process on the Website. The website contains instructions on how to complete your purchase or order and how to check and correct any errors before completing your purchase or order.
4. Price and payment
4.1. The price of the products: The price of the products can be seen from the information on the Website. All prices on the Website are presented in Swedish kronor (SEK) and include, unless otherwise stated, all taxes and fees.
5. Delivery times
5.1. Delivery date: Information about the expected delivery date is presented on the Website in connection with the completion of your order. You will always have access to information about the expected delivery date or expected number of days for delivery before completing your order.
5.2. Delivery costs: Unless otherwise stated on the Website in connection with your order, your ordered products will be delivered free of charge.
5.3. How your products are delivered: Ordered products are delivered either to the address you have entered in connection with your order or to your nearest post office, depending on the scope of your order.
6. Complaint and right of withdrawal
6.1. Complaints: In the event that the product delivered to you is damaged or faulty, you as a consumer have the right to complain about your purchased product within three years after you have received the product. If you discover that your purchased product is damaged or incorrect, please contact us as soon as possible via info@belagom.se. We will provide you with an address to return the product in its original packaging to us free of charge. We aim to resolve any complaints as far as possible within fourteen days of receiving the defective product from you.
6.2. Right of withdrawal: Since our products have a limited shelf life, purchases of our products are not covered by the fourteen-day right of withdrawal that, according to Swedish law, applies as a starting point to consumer purchases of products via the internet.
7. Liability
7.1. Extent of our liability: If we are prevented from delivering our products or are otherwise unable to fulfill our obligations under these Terms due to an obstacle beyond our reasonable control and which we could not reasonably have foreseen or avoided, we shall be entitled to suspend performance for such length of time as is necessary to remove the effects of such impediment. Should fulfillment be postponed with the support of this provision for a period exceeding thirty days, both you and we have the right to cancel the purchase or order. In the event of such an obstacle as described in this clause 7.1, we are not responsible for any damage or loss that may arise as a result of us not being able to fulfill our obligations under these Terms due to the obstacle.
7.2. We are not responsible for business losses: We only supply products for private use to consumers. If you use the products for commercial purposes such as resale, we will have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity (indirect losses/damages).
8. Other
8.1. Assignment of Terms: We may assign our rights and obligations under these Terms to another organization or company. We will always notify you in writing by email via the email address you provided in connection with your order if this occurs and we will ensure that the transfer will not affect your rights under the Terms.
8.2. You need our consent to transfer your rights to someone else: You can only transfer your rights or your obligations under these Terms to another person if we have agreed to this in writing.
8.3. If any part of the Terms and Conditions is deemed invalid, other parts of the Terms and Conditions shall continue to apply: If a court or competent authority decides that any part of these Terms and Conditions shall be deemed invalid, this shall not mean that the Terms and Conditions shall be deemed invalid in their entirety. Instead, the remaining parts of these Terms and Conditions shall continue to apply between Belagom and the customer.
8.4. Applicable law and dispute resolution: These Terms are governed by Swedish law and disputes arising from these Terms must first be tried to be resolved by agreement between us. If such an agreement cannot be reached, the dispute must be settled in a Swedish general court. As a consumer, you also have the option of turning to the General Complaints Board to have a dispute heard (see www.arn.se or visit Kungsholmstorg 5, Stockholm). We participate in the dispute resolution procedure. You can also choose to turn to the European Commission (see http://ec.europa.eu/ odr ).
